Service Terms and Conditions
* "FUP Data" varies from customers to customers depending on the eSIM card purchased, as specified on the relevant packing or our website. Once the aggregate local data usage of a customer in the relevant period beginning from the data usage reaches the relevant Infinity Data usage applicable to the customer, soeSIM shall have the right to reduce and restrict the data access speed (upload and download) to not less than 128 kbps.1. Customers need to activate SIM Card within 60 days after payment. Card is valid for 180 days from the activation date. Each time you recharge your card HK$20 or above, its validity will be reset that the relevant day of extension according to the recharge value to retain the remaining balance and mobile number, or else they will be forfeited.
2. The recurrence service package will renew automatically from the SIM card if the remaining balance is enough. Otherwise, the package will be suspended. Manual termination before package end date will be effective instantly and the remaining free usage will be forfeited at the same time.
3. 24 hours data pass (Hong Kong local/roaming travel) is valid for 180 days after package subscription. After data service activation, the data pass will be valid for 24 hours. Other package (30 days/ 365 days) will be instantly activated after purchase. Once Data Travel Day Pass is effective, the data Network Shield service will be activated and data roaming service is only applicable to designated destinations and networks. Designated operators may change from time to time.
4. Usage of the Day Pass is subject to the coverage, system compatibility and other relevant conditions of the designated networks, which are subject to changes without prior notice.
5. Day Pass shall not be applicable to usage on Peer to Peer ("PTP"). If usage is incurred from or by PTP including applications such as (but not limited to) BitTorrent, edonkey, flashget, foxy, pstream, winmx, etc, or if there is any abusive or abnormal usage, soeSIM shall have the right to forthwith terminate Day Pass without prior notice. All commercial or illegal promotion activities via the use of Day Pass shall be prohibited.
6. Tethering availability depends on network operators in the destinations. soeSIM does not restrict the use of tethering with Data Roaming Day Pass.
7. Day Pass shall not be applicable to aircraft roaming/maritime roaming/satellite roaming.
8. All charges and details (including but not limited to designated destinations and designated networks and their coverage) in respect of Day Pass service shall be subject to the final decision of soeSIM, and soeSIM shall seems necessary in its absolute discretion without priors notice. Notwithstanding anything contained herein, soeSIM shall also reserve the right to accept, reject or otherwise terminate any customer’s subscription of the Pass at any time as soeSIM deems necessary in its absolute discretion.
9. Social Media Data is only available to the use of mobile apps (Facebook, Instagram, WhatsApp, LINE, WeChat and Signal) The social data is applicable for using Facebook (Including Facebook Messenger & Mobile Web & facebook.com) , Instagram, WhatsApp, LINE, WeChat and Signal for local data usage, VoIP voice call, video call, delivery of text and voice messages, images and video clips as well as browse content in word, image or video format except: designated apps download and update, using in-app location based & check in features, playing videos via WeChat Moment & using WeChat wallet, accessing or downloading content from and/or redirection to any other websites or applications within the designated apps and any extra mobile data required by pop up messages. Any other and non-waived mobile data usage will be deducted from the local mobile data. The designated social mobile apps are provided by third party suppliers, the content and the settings of the Social Apps service may change from time to time without any notice. soeSIM shall not be responsible for any liability incurred.
10. The speed experienced by customer may be less than this and will be affected by the network setting, network specification, user's device, transmission technology, individual network and software used, coverage, usage level and extraneous factors.
11. When the data pack has been consumed (if applicable) or the mobile data is consumed under non "Night Fever" period, mobile data will be deducted from local data of plan entitlement. Data usage during the change of the time zone period may be different from the actual data usage due to time difference or delay.
12. The Data usage should comply with "soeSIM Card Service Usage Policy and Fair Usage Policy".
13. "Night Fever" Data Usage and charges is applicable to local data service only. Maximum data access speed (upload & download) is 7.2Mbps.
14. All airtime charges will be based on 1-minute unit (less than 1-minute will be rounded up to the nearest 1-minute)
15. Additional airtime charge will be occurred for IDD airtime usage. All IDD charges will be based on 1-minute unit (less than 1-minute will be rounded up to the nearest 1-minute)
16. The IDD charges and coverage are subject to change from time to time without prior notice.
17. Through the "Data Transfer" service, you can transfer the un-used local data pass/data usage/voice usage of your purchased plans to the soeSIM card. This service is applicable to 24-hour Hong Kong Data Pass/30-day Hong Kong Data Pass/365-day Hong Kong Data Pass/Voice Service Package. Once confirmed, it cannot be cancelled or changed. Each transfer is at least 1 day or 10 minutes or 0.1GB.
18. From 1 March 2022, real-name registration is required before using prepaid service in Hong Kong. Upon insertion of the eSIM card into a mobile device, the defaulted service package / eSIM card validity will start immediately, local services will be activated after real-name registration is completed.
19. soeSIM reserves the right to change the service content and charges without prior notice.
Service Usage Policy and Fair Usage Policy
IntroductionThis policy sets out the guidelines for implementation of soeSIM's Fair Usage Policy for the provision of mobile services by soeSIM to ensure customers shall have a fair opportunity to access to and enjoy the local data network resources of soeSIM
Service Usage Policy
This policy sets out what are considered as unauthorized, unreasonable or improper uses of the various communication, application and content services ("Services") provided by soeSIM. This policy applies to all subscribers and users of such Services. Failure to comply with any of the prohibitions under this policy may cause the relevant Services subscribed to be suspended or terminated by soeSIM or soeSIM to take any steps it considers reasonably necessary or appropriate (including but without limitation to limit the throughput or amount of data transferred) forthwith without notice. Nothing in this policy overrides or prejudices soeSIM's rights under its terms and conditions of service with the subscriber.
Prohibited Uses And Acts
The Services must not be used:
(a) For or in connection with any illegal activities;
(b) To breach another person's rights, including copyright or other intellectual property rights;
(c) To distribute any tool that may compromise or breach any security features or harm or interfere with the normal operations of any network facility or service;
(d) To send or upload any content which is obscene, offensive, abusive, menacing, harassing or threatening in any way;
(e) For resale purposes unless specifically permitted under the terms and conditions of service with the subscriber;
(f) To send unsolicited commercial messages or contents.
A subscriber must not:
(a) Disclose any of his/her personal identification code which soeSIM uses to verify the subscriber's identity;
(b) Falsify any sender or user information or use any tools to mask the identity of the caller, originator or point of origin (whether in whole or in part) of a communication;
(c) Use any program or the transmission of any communication or data to interfere with the normal operations of any Services or soeSIM's network;
(d) Unlawfully intercept or interfere with any communication originating from or terminating on soeSIM's network that is intended for third parties;
(e) Use any tool to compromise or breach any security features or other safeguards implemented by soeSIM in respect of any Services, network facility and/or content.
Fair Usage Policy
This policy sets out the guidelines for implementation of soeSIM's Fair Usage Policy for the provision of mobile services by soeSIM to ensure customers shall have a fair opportunity to access to and enjoy the local data network resources of soeSIM
1 At any time during a Service Cycle, once the aggregate local data usage of a customer in the relevant Service Cycle reaches the relevant Fair Usage Data Threshold applicable to the customer, soeSIM shall have the right to reduce and restrict the data access speed (upload and download) to not less than 128 kbps¹.
2 "Service Cycle" refers to the period beginning from the data usage the customer subscribed to and it varies from customers to customers. "Fair Usage Data Threshold" varies from customers to customers depending on the Prepaid SIM card purchased, as specified on the relevant packing or our official website.
3 The restriction will cease to apply at the beginning of the new service pack subscription.
4 soeSIM will send usage alerts to a customer within a reasonable time after our system recorded that the aggregate local data usage of a customer in the relevant Service Cycle reaches certain level of the Fair Usage Data Threshold. Usage alerts will be sent, including but not limited to, by way of SMS (free of charge).
¹ soeSIM cannot guarantee the actual data access speed (upload and download) experience by the customers which is subject to the influence of various factors which are outside our control including but not limited to the features or functionality of the mobile devices, transmission technology, network performance, websites servers speed, lack of capacity, interruptions to services from other providers and content providers, faults in other communications
Revisions
During the Prepaid SIM Card validity period, the Fair Usage Data Threshold will remain unchanged according to the service plan subscribed by the customer, but soeSIM reserves the rights to revise other terms and conditions of its service at any time without notice, and such revisions shall become effective upon posting on soeSIM's website (https://soesim.com).
If soeSIM revises any terms or conditions of the Prepaid SIM Card Customer Terms for 3 Services provided to the customer, we will by reasonable means and prior notice to the affected customers before effecting the change.
